1. Introduction
   By participating in the Jamba Ice Bath (“Promotion”), participants agree to comply with and be bound by these Terms and Conditions. Jamba reserves the right to amend these terms at any time.
   
   

2. Sponsor
   This Promotion is sponsored by Jamba Juice Franchisor SPV LLC (“Sponsor”).
   
   

3. Promotion Period
   The Promotion begins at 12:00 AM CST on February 13, 2025, and ends at 11:59 PM CST on March 31, 2025, or when 100 complete submissions are received, whichever occurs first (“Promotion Period”).
   
   

4. Eligibility

• Entrants must be Jamba Rewards members with an active account as of February 8, 2025.

• Entrants must be 18 years of age or older at the time of entry.

• Employees, officers, and affiliates of Jamba, its parent companies, subsidiaries, advertising agencies, and their immediate family members are not eligible to participate.

5. Method of Entry

• To enter, entrants must be one of the first 100 customers to purchase any size of each of the six new Jamba Iced Beverages listed below using their Jamba Rewards Account. Only one purchase of an Iced Beverage per day will count towards entry. Entrants must opt into the promotion through their Jamba Rewards Account in order for purchases to qualify.

• Only the first 100 valid submissions will qualify to receive the Ice Bath.

• Limit one (1) entry per individual.

6. Prize Details
Each of the 100 winners will receive Jamba branded inflatable ice bath (the “Ice Bath”) valued at approximately $75.00.

Prize value does not include shipping, fulfillment, or additional costs.

7. Winner Selection
Winners will be selected based on chronological order, with the first 100 eligible participants qualifying for the prize. No additional criteria will be used.

8. Winner Notification
Winners will be notified via the email associated with their Jamba Rewards account within eight weeks of the Promotion’s conclusion. If a winner cannot be contacted, fails to respond, or is deemed ineligible, the prize may be forfeited.

9. Prize Restrictions

• Limit one (1) prize per individual and Jamba Rewards account.

• Prizes are non-transferable and cannot be substituted for cash.

• Jamba reserves the right to substitute a prize of equal or greater value in the event of unavailability.

10. Publicity Release
By accepting the prize, recipients grant Jamba the right to use their name, likeness, and any other information submitted for promotional purposes without further compensation or notification, except where prohibited by law.

11. Tie-Breaker
In the event of a tie (e.g., simultaneous form submissions), winners will be selected based on ranking in the Sponsor's data pull.

12. General Conditions

• Jamba is not responsible for any incorrect or inaccurate information, technical errors, or other issues that may impact the Promotion.

• The Sponsor reserves the right to cancel, suspend, or modify the Promotion at its sole discretion.

• Sponsor (A) shall not be responsible or liable for, and is hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Promotion or from entrants’ acceptance, receipt, possession and/or use or misuse of the Swag Box, and (B) has not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to the Swag Box, including, without limitation, quality or fitness for a particular purpose. Personal information collected in connection with this Promotion will be used in accordance with Sponsor’s privacy policy located at https://www.jamba.com/privacy.

• By participating in this Promotion, each entrant agrees: (i) that any and all disputes the entrant may have with, or claims entrant may have against, the Sponsor relating to, arising out of or connected in any way with (a) the Promotion, (b) the awarding or redemption of any prize, and/or (c) the determination of the scope or applicability of this agreement to arbitrate, will be resolved exclusively by final and binding arbitration administered by JAMS and conducted before a sole arbitrator in accordance with the rules of JAMS; (ii) this arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1-16; (iii) the arbitration shall be held in Atlanta, Georgia; (iv) the arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable entrant may have entered into in connection with the Promotion; (v) the arbitrator shall apply Georgia law consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (vi) there shall be no authority for any claims to be arbitrated on a class or representative basis, arbitration can decide only entrant’s and/or Sponsor’s individual claims; the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (vii) the arbitrator shall not have the power to award punitive damages against the entrant or Sponsor; (viii) if the entrant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of entrant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (ix) with the exception of subpart (vi) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the rules of JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (vi) is found to be invalid, unenforceable or illegal, then the entirety of this arbitration provision shall be null and void, and neither entrant nor Sponsor shall be entitled to arbitrate their dispute. 13. Governing Law
This Promotion is subject to all applicable federal, Georgia state law, and local laws. Void where prohibited.
